After a while of owning one of these and riding it with/without a fork I can say that while it does show a lot of flex in the rear, that problem (or perception of it) seems goes away for the most part when you install a suspension fork. The Front end raises up a bit, but I've been having positive results with this bike as an inexpensive race machine.
Upsides: no creaking at all, seems to resist tube-impacts reasonably well, climbs like a rocket.
Downsides: Internal brake hose meant I had to bleed the system out. Having to get a BB30 crank is inconvenient, but they're nice so I can't really complain.
All in all if I get a season or 2 of racing out of it I'm happy.
Cheers!

@Brent: The fork is completely different. I do not believe it is available aftermarket. I would highly recommend the Niner fork.

The fork look almost identical to the niner carbon...are they the same? do you think their performance is the same? I want a rigid carbon fork for adventure races (mainly fire roads and a little single track and see some of these forks on ebay. What do you think? Should I buy one for $#250 or get the niner? Any other fork you might recommend? I plan to put it on my stumpjumper carbon 29er with tapeered steerer

thanks

@Glancing Aft: No, I didn't have the proper head set available, nor time to fit it into this review period.

Have you done any testing with this bike with a suspension fork at any part during your time with it? I noticed you said that a suspension fork would open up performance more and curious if you had any first hand experience with it.
Thank You
